WebforAuthors Basic Subscription Agreement
Effective March 15, 2005
By subscribing to and using the WebforAuthors Basic system for your website you agreed to abide by the rules and terms set forth in this agreement and in the Policy statements posted on the WebforAuthors website.
Subscription Plans
Three subscription plans are offered.
Subdomain Plan
Domain Hosting Plan
New Domain Plan
Subdomain Plan
The Subdomain Plan uses the WebforAuthors.com address plus your sign up website name. For example, if your signup web site name is "JQAuthor" your web address will be jqauthor.webforauthors.com.
Domain Hosting Plan
If you already own a domain name that you want us to host, select this plan. On sign up we will email you instructions on how to direct your domain name to our servers. You will remain responsible for renewing the domain registration through your existing registrar.
New Domain Plan
When you signup for this plan we will register the new domain name you enter (e.g. jqauthor.com) as the website name. We register it under our name to keep it simple for you. If you let subscription expire we will let the domain name expire. However, we consider you the owner and as long as the name has not expired, we will, at your request, transfer it to you.
Copyright
You agree that all writing and graphics (the "content") that you use on your website is copyrighted by you or that you have permission to use the content and will cite the appropriate copyright source. You also agree that WebforAuthors is granted a non-exclusive copyright to the content in order to create and maintain your website. WebforAuthors will not reproduce or use your content for any other purpose.
Content and Spam
WebforAuthors services may not be used for adult (pornography), illegal, hate or violence related content or to promote books with this content. WebforAuthors services may not be used to spam. By subscribing to WebforAuthors you agree to abide by the terms and conditions in our Content Policy. Complaints regarding spam or content will be investigated and may result in the loss of your account privileges.
Shopping Cart
You may choose to use our optional Shopping Cart or you may direct your readers to another site to buy your books. If you use our Shopping Cart, you agree that WebforAuthors can deduct a 10% charge. You agree that any books or merchandise offered is available for immediate delivery and can be shipped within 48 hours. If you use a print-on-demand service you agree to have the order submitted for printing within 48 hours and to include on your website the approximate delivery time.
Shipping
Our optional Shopping Cart offers buyers the choice of UPS or USPS and you agree to honor the choice they make. You may set additional fees to cover packaging and handling costs. The USP and USPS shipping charges are calculated based on your origin zip code and the destination zip code, weight, carrier and method of shipment. Because we calculate the shipping charges based on information you provide, they are at best an estimate. You agree to absorb any overage or underage that may result. We will not adjust the charge to the buyer after the purchase.
Payment for Books Purchased
We settle accounts with you on the last day of the month. A check for payment of orders processed through our optional Shopping Cart, less the 10% charge, will be mailed on the last day of the month for all orders that are thirty days pass the ship date. We pay thirty days after the ship date to allow sufficient time for returns to be credited within the "15 Day Return Policy" window. You must notify WebforAuthors by email or in writing to issue a credit to a buyer and you agree that the credit amount will be deducted from your settlement or otherwise paid by you.
Guaranteed and Satisfaction Delivery
All Shopping Cart purchases have a delivery and satisfaction guarantee and all shipments are required to have a tracking number. Using the order tracking feature of the Shopping Cart you will email the buyer the tracking number so they know the order is shipped. In case of a dispute, you will resolve the dispute in the buyers favor. This means that if they claim that they have not received the shipment, a full refund will be issued or a replacement will be shipped at no additional charge. You are responsible for the loss and any resulting claim. If you direct your readers to purchase through another website, you agree to guarantee delivery and resolve disputes in the buyers favor.
15 Day Return Policy
Any purchase made through the WebforAuthors Shopping Cart can be returned to you within 15 days from date of receipt for a refund. Shipping and handling do not have to be credited unless the shipment was late or damaged. You agree to include in every shipment a packing slip, return policy and return instructions based on samples we provide that clearly show the sale was made by WebforAuthors. You must notify WebforAuthors by email or in writing to issue a credit to a buyer and you agree that the credit amount will be deducted from your settlement or otherwise paid by you. You agree to have at least a 15 day return policy for purchases made through other channels.
Buyer Complaints
If you follow the WebforAuthors rules, policies and procedures, a website visitor or buyer should never have a reason to contact WebforAuthors as you will have answered any questions and resolved any problems. If someone contacts WebforAuthors with a complaint we will investigate. The complaint may result in the loss of your account privileges if you have not made a reasonable effort to resolve the problem. Be sure to keep accurate and timely documents of problems and resolutions as these could be helpful in resolving disputes. Our goal is complete satisfaction for all our authors, customers and visitors. Please help use meet that goal.
Liability
WebforAuthors shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the service, or for cost of procurement of substitute goods and services, or resulting from any goods or services purchase or obtained, or messages received or transactions entered into through the service or resulting from unauthorized access to, or alteration of member's transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangible assets.
